Preparing Executives to Testify
Following up on Rebecca Blair's earlier post of deposition prep tips for general counsel: Many business professionals think that testifying in a deposition won't be any different than giving a speech before an industry group or negotiating a deal with a client. They're wrong. Almost everyone intends to testify truthfully; a deposition typically requires advance thought to make sure that you can accurately communicate the facts. Latham & Watkins has posted up an article on preparing executives to testify that might be worth looking over before meeting with a lawyer to prepare for a deposition. The main thing to take away from the article is that a deposition is not a normal conversation, and it's not a waste of time and money to go over these issues before walking into the formal deposition.
