Deposition Prep Tips for General Counsel
Where the company is involved in an item of active litigation there will most often be outside litigation counsel who will meet with a company employee before that employee gives a deposition to explain how the deposition will work and what is expected of the witness. Depending on the nature of the company's business, however, there may be other occassions were a company employee is required to give a deposition in a case in which the company is not a party and/or outside litigation counsel has not been retained. For those occassions, here is a good little checklist of basic things to go over with the company employee before that employee gives a deposition. It is also more important than you may realize to give the employee the logistics such as who will likely be present at the deposition and how and why the court reporter, and perhaps videographer, will set up. These things may seem old hat to us but to someone less experienced with litigation, not knowing what to expect can fill the witness with anxiety and result in a poor deposition. Download file
