Here are 4 tips for writing a cease and desist letter, via the IP Counsel Blog. The same principles apply to any letter you send as a prelude to (and hopefully in lieu of) filing a lawsuit. The overarching theme: be polite, and give them a chance to do the right thing. They may not be aware they've wronged your business, and may be willing to make amends if they're not scared off or antagonized by your tone. And even if they don't, it's always best to go into court with the other guy looking arrogant and defiant.
