Recovery of Fee Award Reversed
The Illinois Court of Appeals has reversed a fee award in a breach of contract case, even though the contract permitted recovery of "collection costs."
The Court said: "We must therefore reverse the trial court. We find the contract provision allowing for "all collection costs" was not sufficient to allow recovery for attorney fees. As this case illustrates, attorney fees can be a substantial expense and are an important consideration when entering into contracts. As the drafter of the contract and potential seeker of attorney fees, Servpro had the responsibility to clearly apprise Mid-Northern of its potential liability."
